Kat Mülkiyeti is established for completed structures, whereas Kat İrtifakı can be established before construction is complete. If the buyer’s decision depended on a conversion to Kat Mülkiyeti, make sure that conversion is now reflected in the current registry. TKGM explains that, once a structure with Kat İrtifakı has the required occupancy-permit basis, conversion to Kat Mülkiyeti may be completed under the applicable procedure. A seller’s statement that “the conversion is in process” should not be treated as the same thing as a completed current registration.
Check the land share and unit description one final time
Verify the arsa payı and the registered nature or use attached to the unit. TKGM defines the land share as the common-ownership share allocated to the independent section, and it transfers together with that section. At closing, the point is not to revalue the share but to ensure that the final unit is the unit that was reviewed. A sudden change in the independent-unit number, land-share fraction or registered use needs an official explanation. Do not solve it by changing the contract description to match whatever document appears at the last minute without first understanding why the data changed.
Separate condominium status from encumbrances
Closing-day review of Kat Mülkiyeti does not replace a current check for mortgages, attachments, annotations or other restrictions. A unit may have the correct condominium status and still carry a registered burden that affects transfer or financing. Keep the conclusions separate in the closing file: one line should state the verified ownership regime and identity of the independent unit; another review should address encumbrances. The same separation applies to family-residence annotations, tenant occupancy and other issues.
Do not use Kat Mülkiyeti as an engineering sign-off
The presence of Kat Mülkiyeti should not be converted into a closing-day statement that the building is technically safe. TKGM condominium guidance indicates that project and building compliance are matters for the competent approving authority; the land-registry office does not independently certify structural safety through the ownership registration. If the transaction required an engineering report, occupancy evidence or another technical document, confirm those in their own closing checks.
Questions to answer before money is released
- Does the current official record still show the same independent unit and owner?
- Does it show Kat Mülkiyeti, not a different status?
- If there was a recent conversion from Kat İrtifakı, is the current registry updated?
- Do floor, block, unit number, registered use and arsa payı match the reviewed file?
- Has any correction occurred since the buyer approved the property?
- Are condominium-status questions clearly separated from mortgages, annotations and technical matters?
When to pause the closing
Pause if the current record cannot be produced or verified, if the seller’s description differs from the current status, if the independent unit cannot be mapped to the apartment, or if a material change appears shortly before transfer without official supporting evidence. A last-minute explanation may be correct, but time pressure is not evidence. The issue should be resolved before a payment step becomes irreversible.
What to retain after transfer
Save the current record used on the closing date, the exact identifiers checked, any official evidence of conversion from Kat İrtifakı, the relevant project or unit-mapping material, and the written resolution of any discrepancy. The retained file should allow a later reviewer to understand why the buyer concluded that the transferred apartment had the Kat Mülkiyeti status claimed at closing.
