For kat irtifakı, a developer contract alone is not the revalidation source. Use the current TKGM registration position and compare it with the approved project and permit so the file proves today’s legal state rather than a promised future conversion.
What revalidating kat irtifakı actually means
Revalidation is not merely downloading another copy of the same document. It asks whether the registered status has changed since the first review. Start with the current TKGM record: is the unit still registered under kat irtifakı, has it moved to kat mülkiyeti, and have any new entries appeared that affect the building or unit? Then compare that result with the approved project, building licence and occupancy permit where those documents formed part of the original risk assessment.
TKGM describes a route for conversion from construction servitude to condominium ownership where the occupancy-permit conditions and relevant procedures are met. For that reason, an old due-diligence note saying “conversion is expected soon” must not be carried forward as a fact. Look for the current registration, the relevant Yapı Kullanma İzin Belgesi and evidence of any official step that has actually occurred.
When source freshness becomes critical
Repeat the check if a long period has passed between diligence and closing, construction was completed in the interval, a new occupancy permit appeared, a lender requested a newer record, or the seller changed the description of status. In a multi-block project, do not transfer a conclusion from one block to another; the unit must be tied to its own building and registry entry.
The review should end with a documented conclusion: current registered status, date obtained, and the official evidence supporting any change or lack of change. If the unit remains kat irtifakı, state that fact and assess its effect on the buyer's decision and finance without promising future conversion. If it has become kat mülkiyeti, update the rest of the transaction file so that old descriptions do not continue to conflict with the newer registry position.
When two dated records are compared, identify the exact field that changed rather than merely labelling the newer record “better”.
Compare the registry date with the occupancy-permit and project dates instead of treating “official” as synonymous with “current”. Each source proves a different fact. If one document materially post-dates another, explain why the older evidence remains fit for its limited purpose or obtain a newer version. In a multi-block development, revalidation must stay attached to the exact block; a fresh record for a neighbouring phase does not refresh the target unit.
Revalidation should also test whether the registry still shows kat irtifakı or has moved to kat mülkiyeti since the earlier review. If the status changed, preserve the earlier extract as history but base the present conclusion on the newer registration and the documents that explain the transition. This avoids describing a completed condominium registration as though it were still only construction servitude.
Official revalidation of construction-servitude status
Return to the current TKGM record rather than a developer contract and reconcile the registration with the approved project and building permit. The aim is to prove what is registered today and whether unit, share and plan remain consistent; a promise of future conversion to Kat Mülkiyeti is not evidence that conversion occurred.
