Foreign buyer eligibility Recordkeeping Guide

Start with buyer nationality/status and parcel location, and tie both to the exact property, party and transaction date. For recordkeeping, test the strongest claim first. If property type conflicts with special restrictions, preserve both pieces of evidence and identify the reason for the conflict before treating the file as complete. Example: the file contains buyer nationality/status, but transaction eligibility cannot be verified. Do not mark “Foreign buyer eligibility Recordkeeping Guide” complete.

Foreign Buyer Eligibility Recordkeeping Guide

Eligibility recordkeeping is the evidence layer that allows a foreign-buyer decision to be reconstructed months or years after closing. The file should show not only the conclusion that the buyer was eligible, but the identity of the buyer, the exact property, the legal route used, the official sources checked, the date of each check and every condition that remained open before registration. Good recordkeeping is especially important because eligibility rules and property facts can be time-sensitive, while a later reviewer may have no access to the conversations that produced the original conclusion.

Create a transaction-specific identity header

Open the file with a compact identity sheet. For a foreign natural person, record the name exactly as used in the land-registry process, nationality, passport or identity-document reference, any relevant multiple nationality and the representative, if one is used. For a company, record the legal entity category, jurisdiction of incorporation, company identifiers and the person authorized to act. Avoid copying the generic label 'foreign buyer' into every field because it hides the classification on which the legal route depends.

On the property side, record province, district, neighborhood or village, ada, parsel and, where relevant, building and registered independent-section information. Add the current title reference used for the transaction. If the sales office uses a commercial unit number, preserve the mapping to the registered unit. A recordkeeping file should make it impossible to confuse the checked property with a similar unit in the same project.

Preserve the source of each eligibility conclusion

For every material conclusion, keep the source that supports it. The file should identify the version or date of the official guidance or authority output used for nationality eligibility, statutory area limits, security-zone issues and any special permission. A URL alone is not enough if the page may later change; record the date checked and, where permitted, retain a PDF, official printout, application reference or screenshot that captures the relevant result without creating a false appearance of official certification.

Separate general law from transaction evidence. Article 35 and official guidance explain the rules, but the buyer’s passport, existing-holding information and parcel-specific authority result show how those rules apply to the actual case. The strongest file contains both layers and makes clear which document proves which fact.

Track cumulative holdings and statutory-limit evidence

If the buyer is a foreign natural person, keep the information used to assess existing holdings and the statutory national and district limits. Preserve the buyer declaration, official search or land-registry result available through the transaction, and the date of the assessment. If the buyer later acquires another property, do not overwrite the earlier file; the old assessment should remain linked to the transaction date on which it was made.

When an issue is not fully determinable by the transaction team, record the escalation. For example, if district aggregate capacity or a special-area restriction requires official confirmation, the file should show the request, the authority response and any condition. This prevents a later reader from mistaking an internal estimate for an official eligibility finding.

Record permissions and conditions as separate objects

Permissions should not be reduced to a yes/no note. Store the authority, application date, application or file number, parcel, buyer, scope, decision date, conditions and the document that proves the outcome. If a special-security-zone acquisition requires permission, the record should remain conditional until the permission is actually issued. If a restriction does not apply, preserve the evidence for that non-application when it was material to the decision.

Do the same with undeveloped land. If the acquisition creates a post-purchase obligation to apply to the relevant public administration within two years to develop a project, record the obligation, responsible person and target date separately from the initial acquisition approval. Post-closing obligations should never disappear merely because title registration succeeded.

Use version control instead of silent editing

Eligibility files change as new passports are issued, parcel identifiers are corrected, additional holdings are discovered or authority responses arrive. Never replace a material value without preserving the previous value and the reason for change. Use dated notes or document versions. If a passport number changes, keep the historical identity link; if a parcel reference is corrected, preserve the evidence explaining the correction.

The same principle applies to due-diligence conclusions. An early status may be 'unresolved', later 'conditional', and finally 'passed'. Preserve that progression. It shows that money was not released on the basis of a result that only became available later, and it protects the integrity of the transaction audit trail.

Separate eligibility from citizenship and residence files

Foreign-buyer eligibility to acquire real estate is not the same as eligibility for Turkish citizenship, a residence permit or a particular investment incentive. If the buyer also pursues citizenship or residence, create linked but distinct evidence sections. This prevents a USD-value threshold, valuation requirement or residence document from being mistakenly treated as a condition for ordinary property ownership when it belongs to another legal objective.

Likewise, transaction documents such as the foreign-currency purchase document or banking evidence should be filed according to the procedure for which they are required. The recordkeeping guide should cross-reference them without turning every later procedural requirement into an acquisition-eligibility rule.

Close the file with a reproducible decision record

At registration or the final pre-closing review, create a one-page decision note identifying the buyer, property, date, classification, checks completed, permissions obtained, open post-closing obligations and the person who reviewed the file. The note should point to the underlying documents rather than repeat large amounts of generic text.

A good archive lets an independent reviewer answer: who bought, what property was tested, which rule applied, what official evidence existed on that date, what conditions were satisfied, and what remained for follow-up. Recordkeeping is not administrative decoration. It is the mechanism that prevents a later change in a website, staff member or buyer portfolio from erasing the factual basis on which the original eligibility decision was made.

Frequently asked questions

What is the minimum evidence set for a foreign-buyer eligibility file?

Keep the buyer’s identity and nationality/status evidence, current title and parcel records, restriction checks, representation documents, applicable payment/foreign-exchange evidence, and the land-registry closing record. The index should show which document supports each eligibility conclusion.

Why is version control important in this file?

Eligibility evidence can change between reservation, contract and closing. Save dated versions or official retrieval details so a reviewer can see what was known at each decision point and can distinguish a superseded document from the current one.

How should a power of attorney be recorded for a foreign buyer?

Keep the executed instrument, its date, issuing authority or notarization details, translation/apostille or legalization evidence where applicable, and a note of the powers actually relied on. Do not store only a cropped signature page or an informal translation.

How should official online checks be preserved?

Record the official service used, retrieval date, property or party identifier queried, and the resulting document/reference number when available. A screenshot without context is weak evidence because it may not show what was searched or when.

What should the closing index show?

The closing index should map every material eligibility question to the final evidence used, its date, and the person who reviewed it, and identify superseded documents separately. This creates a durable audit trail without mixing drafts with the final transaction file.
