Reconstructing a power-of-attorney audit trail is different from asking whether the authority is valid today. The objective is to build a reviewable chronology showing how authority arose, what document versions existed, when they changed or were used, who relied on them, and what evidence supported continuing authority at each material decision. This becomes especially important where the file contains several powers of attorney, competing translations, substitute agents or payments made before the controlling version was clearly identified.

Establish the legal starting point

Begin with the earliest instrument connected to the transaction. Record its date, number, issuing authority, principal, agent and core powers. If it was executed abroad, add the relevant authentication, apostille or consular route and translation history. Preserve the document as it existed at each stage, not merely the final clean copy. An audit trail must show what the transaction team could actually see when a decision was made.

Build a version ledger

Enter every later version or related authority event separately: a new certified copy, corrected translation, replacement power, change of agent, supplemental authority or substitution instrument. For each item record source, receipt date, reason and reviewer. A change that appears minor, such as corrected wording in a translation, can determine whether the agent was understood to have authority to sell, receive price, sign declarations or appoint a substitute. The ledger should therefore distinguish the legal original from administrative copies and translations.

Reconstruct the substitution chain

Where the acting person derives authority from another agent, the audit trail must show how that authority travelled. The Land Registry Regulation requires the underlying power of attorney where the first agent relies on a right of substitution. Preserve the chain from principal to first agent, the wording granting substitution, the substitute instrument and the identity of the final acting person. A missing link must remain an exception; it should never be filled by inference.

Record revocation and termination checks as dated events

A note saying “POA valid” is too weak for an audit trail. Record when revocation or termination was checked, by whom, and against which source or evidence. If a later event such as revocation, resignation, death, loss of capacity or expiry appears, place it on the chronology and identify the first transaction decision it affected. TKGM explains that document age alone does not terminate authority, so the trail should focus on actual legal events rather than using an arbitrary age threshold.

Link money and commitments to the version available at the time

For each deposit, major payment, contract signature, bank instruction or title appointment, identify the exact power of attorney in the file and the result of the contemporaneous authority review. If money was released on a copy later found incomplete, the audit trail should show that fact rather than rewriting history as though the correct document had always been present. This is essential for responsibility analysis, recovery rights and deciding whether an earlier approval needs remediation.

Include TAKBİS and archive events

If an instrument was previously used at a land-registry office and uploaded to TAKBİS, record the office, date if known and verification result. For foreign powers of attorney, current TKGM archive instructions may require retention of originals because those documents cannot be verified through Turkish Notaries Union systems in the same way as domestic instruments. These events help explain provenance and custody but do not replace analysis of the authority wording.

Resolve conflicts without erasing them

If two translations, versions or dates conflict, preserve the superseded item and mark why it was rejected or replaced. Where a later power replaces an earlier one, or a revocation cuts off authority, show the transition date explicitly. A good audit trail allows an independent reviewer to understand not only the final answer but why a particular decision was reasonable or unreasonable based on the evidence available at that time.

Final audit output

The completed record should contain a dated event sequence, reference copies, official-source links, the authority scope at each relevant stage, decisions affected by each version and a clear final status. The audit cannot be closed while there is an unexplained gap in principal identity, agent identity, substitution authority, revocation timing or the version actually used for a material transaction step.
